Obstruct of Income Tax Return Did Not Breach Federal Law, Washington Court Holds

The Washington State Court of Appeals concurred with the state’s Department of Work Security recently and discovered that the department properly followed the federal balanced out law prior to obstructing a personnel lawyer’s tax refund due to the department overpaying his welfare due to COVID-19.

The Washington Department of Work Security (DES) identified that Michael Weisman, a personnel lawyer for the Washington State Department of Health, underreported the hours he worked for 2 weeks, leading to the overpayment of joblessness insurance coverage advantages to cover his furloughed time. The department alerted Weisman of his liability for the overpayment payment and stated his tax refund might be obstructed to balance out the financial obligation, according the appellate court’s viewpoint submitted June 5.
