Maine Court to Choose Company’s Liability for Staff member’s Usage of Racial Slur

The Maine Supreme Judicial Court is thinking about whether the management business of a Portland McDonald’s franchise can be held vicariously accountable after among its staff members screamed a racial slur to a client he had actually served in the drive-thru.

James Clifford, a partner of Clifford & & Clifford in Portland, on behalf of the complainants, Tiffany Vargas and Erika Acevedo, challenged Cumberland County Superior Judge Thomas R. McKeon judgment in favor of the McDonald’s franchisee, Riverbend Management, and the prejudiced remark from among its staff members, Andrew Mosely.
